What if the biological father lives in Mexico — can I still adopt?
Yes. The biological father's location in another country does not prevent you from filing for adoption. You file where you and the child live.
How service works with a parent in Mexico:
- If his address is known: Service may go through the Hague Convention process or Mexican legal channels
- If his address is unknown: Service by publication in a local newspaper satisfies the legal requirement
- If he's cooperative: He can sign consent at a U.S. consulate or embassy in Mexico
Abandonment still applies: If the father hasn't had meaningful contact with the child for the required period (varies by state, typically 6–12 months), abandonment can be established regardless of where he lives. Living in another country doesn't excuse lack of contact.
