What if my stepchild doesn't want to be adopted in Arkansas?

If your stepchild is 12 or older, Arkansas sets a consent age of 12 (A.C.A. § 9-9-206), so their willingness matters, and you will want to work through their hesitation before filing in Circuit Court. If your stepchild is younger than 12, their feelings still matter to your family, but the consent age is what the statute turns on.

What the law tells us: Arkansas's child consent age is 12. Anything beyond that, such as what the Circuit Court does when a child objects or how it weighs a younger child's wishes, depends on the facts of your case. Ask the Circuit Court clerk in your county or an attorney about your situation.

Why a child might hesitate:

  • Loyalty to their other parent, and a feeling that adoption "replaces" them
  • Fear of change
  • Not fully understanding what adoption means
  • Teenage pushback on adult decisions in general

What often helps:

  • Talk about what adoption means and doesn't mean. Keep it age-appropriate, and ask questions as much as you explain.
  • Reassure them. Adoption doesn't erase the people they love or their history.
  • Listen first. Let them say what worries them before you respond. A child who feels heard is more likely to engage.
  • Give it time. Nothing requires you to file on a particular schedule. A stepparent adoption in Arkansas typically takes 3-6 months once the paperwork is filed, so waiting until your child is ready costs you little.
  • Consider a family counselor if the hesitation runs deep or the topic causes conflict at home.

Other parties to the adoption: A child's feelings are only one part of the picture. The other consents or grounds for waiver (such as the other parent's consent or an abandonment period of 12 months under A.C.A. § 9-9-207) are separate questions. If your situation involves a contested case or a parent who can't be found, the clerk or an attorney can tell you how it applies to you.

If your stepchild says no for now: You don't have to treat it as final. Many stepparents wait until a child is more comfortable, and Arkansas permits adult adoption. Under A.C.A. § 9-9-203, any individual may be adopted, and an adult is anyone 18 or older. An adult adoption requires the adult's own written consent (and their spouse's, if they're married), and it typically runs about 4-8 weeks. The court may direct a home study, but one isn't required unless it does. Waiting until your stepchild is an adult is an option if they aren't ready now, and it means the decision is entirely theirs.

Keep the relationship the priority: Your bond with your stepchild doesn't depend on a court order. Pressure to "say yes" can damage the trust you've built, while patience, honesty and respect for their feelings usually serve the relationship better than any timeline.
