What happens if the bio parent shows up at the hearing to contest adoption in Indiana?

If the other biological parent shows up to contest your adoption, the Indiana Circuit or Superior Court judge will hear the situation and decide based on the facts, and the objection does not automatically stop the adoption. Indiana courts can proceed without a parent's consent when that parent has failed to maintain meaningful contact or support.

What the judge looks at. A contested hearing is different from the brief, positive final hearing most stepparent adoptions have. The judge focuses on the other parent's actual involvement with your child. Indiana's abandonment provision, Ind. Code § 31-19-9-8, uses a six-month period. How that period and the other parent's contact and support history apply to your situation depends on your facts, so an attorney or the Circuit or Superior Court clerk in your county should answer that for you.

If the parent was notified but doesn't agree. Disagreeing with the adoption is not the same as having a legal basis to block it. The court weighs what each side presents. A parent who has stayed in touch and supported your child will be in a very different position from one who has not.

If the parent could not be found. Indiana has procedures for giving notice by publication when the other parent cannot be located after reasonable efforts. If a parent appears after a search like that, the details of how notice was handled matter. Talk to the clerk or an attorney about that specific issue.

Unpaid child support. Back child support does not prevent an adoption in Indiana. The adoption may not eliminate existing support obligations, so ask the court how your situation would be handled.

How to prepare:

  • Keep records of the other parent's contact, calls, visits and support payments, or the lack of them.
  • Make sure the other parent's address and notice details are accurate and complete in your paperwork.
  • If you expect a fight, consult an Indiana family law attorney about the hearing itself. A contested case depends on facts, and that is individualized legal advice we cannot give.
  • Call the Circuit or Superior Court clerk in your county with procedural questions, such as how objections are scheduled.

Staying realistic. Many parents worry about this possibility, and it is reasonable to plan for it. Still, a parent appearing at the hearing is only one possible scenario, and the judge's decision turns on the evidence about the parent's relationship with your child.
