What happens if the bio parent shows up at the hearing to contest adoption in Alaska?

If the biological parent shows up to contest, the Superior Court judge will not simply proceed as planned; the court will want to hear the objection and decide it based on the facts of your case. What happens next depends on your situation, so it helps to know the pieces Alaska law gives you.

The court and the process. Stepparent adoptions in Alaska are handled by the Superior Court. A stepparent adoption typically takes about 3-6 months from filing. A contested hearing can change that timeline, and the clerk can tell you how scheduling works in your area.

Consent and abandonment. A parent's consent is normally part of the adoption. Alaska's abandonment provision, Alaska Stat. § 25.23.050(a)(1)-(2), uses a six-month period. If you plan to rely on abandonment, the judge will look at the evidence of what contact and support did or did not happen. Whether a particular parent's history meets the statute is a fact-specific question, so an attorney should review it before your hearing.

Notice matters. If a parent appears and says they were not properly notified, how the court responds depends on your case. The Superior Court clerk in your borough can confirm the notice and response rules that apply to you. An attorney can tell you how they affect your situation.

What to expect if the parent is there:

  • The judge may ask each side to explain their position.
  • You may be asked about your relationship with the child and the parent's involvement.
  • The judge may decide at the hearing or take the matter under advisement. Either is possible, and the clerk or an attorney can tell you what is likely in your court.

The child's voice. In Alaska, a child who is 10 or older must consent to the adoption under Alaska Stat. § 25.23.040. If your child is that age, their consent is part of the picture regardless of what the parent says.

Home study. Alaska waives the home study in stepparent adoptions under Alaska Stat. § 25.23.100, so a contested hearing does not necessarily mean extra investigation steps. If the court wants more information, it will tell you.

Residency. Alaska has no minimum residency period for filing.

How to prepare:

  • Gather records showing the history of contact, support, and communication, or the lack of it.
  • Keep copies of everything you filed and every notice that was sent.
  • If you know a parent plans to object, speak with an Alaska family law attorney about the hearing itself. A contested hearing depends on facts that only a lawyer can evaluate for you.
  • Ask the Superior Court clerk about hearing procedures in your borough, including anything that applies in Anchorage, Fairbanks, Juneau, Sitka, or Ketchikan.
