What are the adoption laws in Oklahoma?

Oklahoma adoption law is found in Oklahoma Statutes Title 10, Article 75, and every adoption is approved by the District Court in the county where the family files. For a stepparent adoption, that means meeting a few set requirements and getting the court's approval, and the process typically takes 3-6 months.

Who files and where: Oklahoma has 77 counties, and your petition goes to the District Court in your county. Each court may have its own forms and local habits, so the clerk is a good source for county-specific details.

Adopter age: For minor adoptions, an unmarried adopter or a married couple adopting together must generally be at least 21. No age minimum applies when one spouse adopts and the other spouse is the child's parent or relative (10 O.S. 7503-1.1).

Residency: Oklahoma has a residency requirement of 6 months (10 O.S. § 7502-1.2). The District Court clerk can confirm exactly how it applies to your family.

  • A child who is 12 or older must consent to the adoption (10 O.S. § 7503-2.1).
  • Your petition needs consent forms from the people whose consent is required, or grounds for waiving consent.
  • Your spouse, the child's parent, must also consent to the adoption.

The other parent: Termination of the other legal parent's rights is handled as a separate step from the adoption itself. Abandonment is one ground that may come up, and Oklahoma uses a 12-month period (10 O.S. § 7505-4.2). Whether it fits your situation depends on your facts. If the other parent is contested or can't be found, talk to the District Court clerk or an attorney about that specific issue.

Notice to the other parent: Oklahoma allows personal service by a sheriff or process server. If a parent's location is unknown, service by publication may be allowed after a diligent search.

Home study and background checks: The home study is waived in stepparent adoptions (10 O.S. § 7505-5.2(B)). Oklahoma does require OSBI (state) and national background checks for adoption petitioners.

Cost: Court filing fees typically run $150-$300. The total cost of a stepparent adoption is typically under $1,000 when you prepare the paperwork yourself. Attorney-handled adoptions commonly run $3,000-$5,000+.
