You adopt your stepchild in Oklahoma by filing a petition for adoption in the District Court in your county, getting the required consents (or grounds to waive them), and attending the court process through to a final decree. Oklahoma has 77 counties, and a stepparent adoption typically takes 3-6 months.
The basic steps
- Prepare and file a Petition for Adoption with the District Court.
- Include consent forms, or the grounds for waiving consent, along with your spouse's consent to the adoption.
- Pay the court filing fee, typically $150-$300.
- Complete the OSBI (state) and national background checks that Oklahoma requires of adoption petitioners.
- Have the other parties properly served. Oklahoma allows personal service by sheriff or process server, and service by publication if a person's location is unknown after a diligent search.
Who can adopt. Oklahoma generally sets a minimum age of 21 for adopters, but no age minimum applies when one spouse adopts and the other spouse is the child's parent (10 O.S. 7503-1.1). That is the usual stepparent situation.
Residency. Oklahoma has a 6-month residency requirement (10 O.S. § 7502-1.2). Your District Court clerk can confirm how it applies to your family.
Consent. A child who is 12 or older has a consent role under 10 O.S. § 7503-2.1. Your spouse, the child's parent, must also consent in writing. If the child's other legal parent is in the picture, their consent or a legal ground to proceed without it is part of the process.
The other parent. In Oklahoma, termination of the other parent's rights is a separate matter from the adoption itself. Abandonment is one ground the law recognizes, and its period is 12 months (10 O.S. § 7505-4.2). Whether it applies depends on your facts. If the other parent is unknown, unreachable or objects, the District Court clerk or an attorney can advise you on that specific situation.
Home study. Oklahoma waives the home study in stepparent adoptions (10 O.S. § 7505-5.2(B)). That removes a step that can add time and cost in other kinds of adoption.
Cost. Court filing fees typically run $150-$300, and the total for a stepparent adoption is typically under $1,000 if you handle the paperwork yourself. Hiring an attorney commonly costs $3,000-$5,000+.
After the adoption. Birth record changes are handled through the Oklahoma State Department of Health Vital Records. Your clerk can tell you which court documents you will need to bring.
Where to file. Your case goes to the District Court in your county. Families in Oklahoma City, Tulsa, Norman, Broken Arrow, Lawton and elsewhere follow the same general process, but local forms and procedures can differ, so check with your county clerk.
