Request the accommodation through the court that has jurisdiction over the adoption. Remote participation or another arrangement may be available, but it must follow the court's procedure. Do not assume every adoption hearing is virtual or that a generic cover letter guarantees approval.
Contact the court early
Identify the court's ADA coordinator, chief clerk or other designated contact. Explain the participation barrier and the accommodation needed. Follow the court's instructions for supporting information and confidentiality. Ask how the request relates to a required appearance or the assigned judge's hearing schedule.
New York's actual process
The New York Courts accommodation guidance identifies remote appearance as one possible judicial accommodation. Its request instructions describe requests by online form, email, letter or telephone and ask for the case, dates, contact information and requested accommodation. Make the request early enough for the court to arrange it.
Domestic Relations Law section 115(9) also addresses dispensing with personal appearance in specified circumstances for good cause. Signing, acknowledgment and notice requirements still need attention. The court's approval determines what participation is permitted.
Prepare a useful request
State the functional limitation, the participation you need, and any relevant hearing date or deadline. Include the case number and assigned judge if known. Use the designated confidential process for medical information; do not send sensitive records to unrelated parties or put unnecessary details in a public letter.
Confirm the arrangement
Ask whether the request has been decided, who must attend, how to connect, and how documents will be presented or signed. Test the required technology and plan what to do if the connection fails. If the requested format is unavailable, ask about alternative accommodations.
Residence and venue determine where the case belongs. Do not file in a different state simply to avoid travel or obtain a lower filing fee.
