My child's biological father was never on the birth certificate. Do I still need his consent in Washington?

If the biological father was never on the birth certificate and never established paternity legally, his parental rights may be limited or nonexistent in Washington. However, the answer depends on the specific circumstances:

If he never acknowledged paternity: He may have no legal standing to contest the adoption. The court may only require a reasonable effort to notify him.

If he's known but uninvolved: You'll still need to make a good-faith effort to serve him with notice. If he doesn't respond, the adoption proceeds.

If his identity is truly unknown: The court can proceed without notice to an unknown father.

In Washington, adoptions are filed in Superior Court. We include the appropriate documents based on your specific situation — just indicate the father's status on the questionnaire and we'll prepare everything correctly.

This scenario is more common than you might think, and courts handle it routinely.
