No, Pennsylvania does not set an age limit for adult adoption. The statute says "Any individual may be adopted, regardless of his age or residence" (23 Pa.C.S. 2311). For an adult, the practical starting point is simply that the adoptee is 18 or older, because adoptees under 18 follow different rules.

Other age conditions. The statute has no minimum age for the adopting parent and no required age gap between adopter and adoptee. It also has no relationship, prior-contact, or spouse-bar condition. If you have a specific question about your family's situation, the Orphans' Court clerk in your county or an attorney can confirm it.

  • The adoptee. Consent is required from any adoptee over 12 (23 Pa.C.S. § 2711), so an adult must agree to the adoption.
  • The adopter's spouse. The spouse must consent unless they join the petition.
  • The adoptee's parents. Their consent is required only when the adoptee is under 18.
  • A guardian. If the adoptee is incapacitated, the guardian consents.
  • The court's discretion. When the adoptee is over 18, the court may dispense with every consent except the adoptee's (23 Pa.C.S. 2713).

The statute does not list consent from the adoptee's own spouse. If that applies to you, ask the clerk or an attorney.

Residency. Pennsylvania has no minimum residency period, and the statute says "regardless of his age or residence." Where you file depends on venue: the county where the parent or parents, the adoptee, or the person who filed the report of intention to adopt lives (23 Pa.C.S. § 2302).

Home study. A home study is not required for adults. The report of intention and investigation provisions apply to a child under 18. The court may still request an investigation by a person or public agency (23 Pa.C.S. 2724).

Court and hearing. Adoptions are filed in the court of common pleas of the county, through the appropriate division. Orphans' Court is common practice, and your county clerk can tell you where your petition goes. A hearing is required (23 Pa.C.S. 2721). The adopting parent or parents and the adoptee must appear, and testify if required, unless the court finds their presence unnecessary (23 Pa.C.S. 2723).

Timeline. Adult adoptions in Pennsylvania typically finalize in 4-8 weeks.

Common reasons families pursue adult adoption:

  • Formalizing a long-standing parent-child bond, such as a stepparent and an adult stepchild
  • Creating legal family ties and inheritance rights
  • Official recognition of a family relationship
