Is there an age limit for adult adoption in Oregon?

Oregon's only age rule is for the person being adopted, who must be 18 or older or legally married, and Oregon has no minimum age or age-gap requirement between the adopting person and the adult being adopted. The statute is ORS 109.329, and adult adoptions are filed in Circuit Court.

What the age rule means for you:

  • The adoptee must be 18 or older, or legally married, when the petition is filed.
  • There is no required age difference between the adopting person and the adult adoptee.
  • There is no relationship or prior-contact condition. A stepparent adopting an adult stepchild, or a mentor formalizing a long-standing parent-child bond, can petition.
  • The information available to us does not state a maximum age for an adoptee. If your situation involves an unusual age circumstance, the Circuit Court clerk in your county can confirm how it is handled.

What the court looks at instead of age: The judge must find that each petitioner understands the significance and ramifications of the adoption and is not acting under duress, coercion or undue influence. The court must also be satisfied that the adoption is "fit and proper" (ORS 109.329).

Consent: Earlier versions of this page said only the adoptee's consent is needed. That was incomplete. Oregon requires the written consent of each petitioner and of the person being adopted, filed with the petition (ORS 109.329). Birth parents do not consent to an adult adoption. The court may also require notice to a petitioner's spouse, to a person living with a petitioner, and to a petitioner's adult children.

Residency and where to file: One petitioner or the adoptee must have lived in Oregon continuously for six months before filing. You file in the county where a petitioner or the adoptee lives (ORS 109.329).

Home study and hearing:

  • A home study is not required for an adult adoption.
  • The court may appoint counsel or a visitor for either party.
  • Holding a hearing is up to the court. The judge may hold one, take testimony or hold a conference.

Timeline: Adult adoptions in Oregon typically finalize in about 4-8 weeks, though timing depends on your county's court schedule.

When to get extra help: If family members may object, if you are unsure who should receive notice, or if you have a question about inheritance or other legal effects, ask the Circuit Court clerk in your county about procedure. For advice on your specific situation, talk with an Oregon attorney. The clerk cannot give legal advice, but can explain filing steps.
