How does PCS move affect stepparent adoption in Nevada?

A PCS move does not add a waiting period to a stepparent adoption in Nevada, because Nevada sets no minimum residency period (NRS 127D.120(1)). If you have just arrived on orders, you do not have to wait a set number of months before you begin.

Arriving in Nevada on PCS orders

  • With no minimum residency period, a new arrival does not have to count months before preparing a petition.
  • Nevada has 17 counties, and the petition goes to the District Court. Your District Court clerk can tell you which county's court fits your situation and what the filing fee is.

Moving away during the process

  • Nevada's data does not spell out how a case is handled once the family has left the state. Ask the District Court clerk whether your hearing can be attended remotely, or whether you need to travel back.
  • Nevada does not require a home study (NRS chapter 127D). That means no home visit to schedule around packing, travel or a new address.
  • The typical stepparent adoption timeline is 3-6 months. If you have orders with a report date, compare that timeline with your move date and plan accordingly.

Consents and your move

  • If your child is 14 or older, the child's consent is part of the process (NRS 110(1)(c) applies as written below: NRS 127D.110(1)(c)).
  • The other legal parent's consent is a separate step. If that parent cannot be reached or has not been in contact, Nevada refers to a 6-month abandonment period (NRS § 128.012). Whether it applies to your family depends on your facts. For a contested case or an unknown parent, talk with the clerk or an attorney about your specific situation.
  • Termination of the other parent's rights is handled separately in Nevada. Gathering signatures or paperwork from the other parent can take time, so start early if a move is coming.

After the adoption

  • Once the adoption is final, you can request an updated birth certificate through the Nevada Office of Vital Records.
  • Military dependent ID, TRICARE enrollment and similar benefits are handled by your installation's ID office and TRICARE. Ask them which court documents they need, so you can request certified copies at finalization.

Practical tips for a PCS family

  • Keep copies of your orders, marriage certificate and your child's birth certificate where you can reach them during the move.
  • Confirm with the clerk how notices and the hearing date will reach you at a new address.
  • Ask the clerk early about remote participation.
