How does PCS move affect stepparent adoption in Hawaii?

A PCS move to Hawaii does not create a waiting period for stepparent adoption, because Hawaii has no minimum residency period (HRS § 578-1). You can start your case in Family Court without first waiting out a set number of months after you arrive. A move also does not change the other requirements, so it helps to plan around them.

If you just arrived in Hawaii:

  • Hawaii has four counties, and your case is filed with the Family Court that serves yours, such as the one covering Honolulu, Kapolei, Pearl City, Kailua or Hilo.
  • Because there is no residency minimum, your arrival date is not a barrier. The Family Court clerk can confirm what paperwork they want to see about where you live.
  • Typical timeline for a stepparent adoption in Hawaii is 3-6 months.

If you may PCS away during the case:

  • Whether you can attend a hearing remotely, or how a move affects your court dates, is a question for the Family Court clerk in your county. Ask before orders arrive so you can plan around the schedule.
  • Hawaii does not waive the home study (HRS § 578-8). Ask the clerk how a move out of state could affect scheduling it.
  • Since the timeline runs 3-6 months, starting before your move date gives you more room to work with.

Requirements that stay the same no matter where you are stationed:

  • Child's consent: A child who is 10 or older must consent (HRS § 578-2).
  • Other parent: If the other parent's consent is involved, or if the case turns on abandonment, Hawaii uses a 12-month period (HRS § 578-2). Contested cases and unknown-parent situations depend on the specific facts, so talk to the court clerk or an attorney about your situation.
  • Filing fees: The Family Court clerk in your county can confirm the current amount.

After the adoption:

Questions about updating a birth certificate go to the Hawaii State Department of Health Office of Health Status Monitoring. For military dependent status, ID cards or health coverage, check with your installation's ID office, since those rules are set by the military and not the Family Court.

Planning tips for military families:

  • Keep copies of your orders and your family's identification together with your adoption paperwork.
  • Tell the clerk early if a move or deployment is possible.
  • Make sure the other parent's contact information, if available, is current before you file, since a move can make that harder later.
