How do I serve adoption papers on a parent in a foreign country from Massachusetts?

In Massachusetts, you serve a parent who lives abroad by following the process the Probate and Family Court in your county requires for that parent's country, so your first step is to ask that court's clerk which method and paperwork the court will accept. The data I work from doesn't set out foreign-service methods, so the clerk or an attorney is the right source for those details.

Why the parent's notice matters. Under M.G.L. c. 210 § 2, an adoption petition needs the written consent of the child's lawful parents. If the other parent is overseas and will sign, ask the clerk how and where a consent signed abroad should be completed so the court accepts it. If the parent won't sign, or you can't reach them, the steps depend on the facts of your situation, and an attorney can advise you on that.

If the parent has been out of contact. Massachusetts sets no fixed number of months for abandonment. Under M.G.L. c. 210 § 3, it depends on the parent's overall conduct. Being far away or silent for a while doesn't automatically settle the question, and whether a parent's absence affects the need for consent is a decision for the court. If your case may be contested, talk with an attorney about that specific issue.

If you don't know where the parent is. What the court expects when a parent's address is unknown is also something to confirm with the clerk or an attorney. It's a good idea to gather whatever you have first:

  • Last known address, phone number, email or social media contact
  • Names of relatives or friends who may know where the parent is
  • Records of past contact, child support, or visits

Questions to ask the clerk.

  • Which service or consent method does the court accept for the country where the parent lives?
  • Are there translation or paperwork requirements for documents going abroad?
  • How long should we allow for the parent to receive and respond to the papers?
  • What proof of service or consent does the court want filed?

Plan for timing. A stepparent adoption in Massachusetts typically takes 3-6 months. Reaching a parent overseas can take extra time, and the clerk can tell you what to expect for your situation.

Other pieces that stay the same. Your child's own written consent is required if the child is above age 12 (M.G.L. c. 210 § 2). The DCF investigation under M.G.L. c. 210 § 5A is waived for stepparent adoptions, so the foreign parent's location won't change that part of the process.
