Can I adopt my stepchild if the biological father lives in another country and we live in Massachusetts?

Yes, you can file a stepparent adoption petition in the Massachusetts Probate and Family Court even though the biological father lives in another country, and Massachusetts sets no minimum residency period before you file (M.G.L. c. 210 § 1). The main question is usually the father's consent, not where he lives.

Where you file: Stepparent adoptions are handled by the Probate and Family Court. The clerk of the court in your county can confirm which county is the right one for your family.

The father's consent: Under M.G.L. c. 210 § 2, the written consent of the child's lawful parents is required, and that includes the biological father. If he is willing, a signed consent is the most direct route. How a consent signed abroad must be witnessed or authenticated is not something we can estimate, so ask the court clerk or an attorney before he signs anything.

If he won't sign or can't be found: Massachusetts looks at abandonment under M.G.L. c. 210 § 3. There is no fixed number of months. Abandonment depends on the parent's overall conduct. That means the court looks at the whole picture, such as contact, support and involvement, rather than counting days. Living in another country is one fact among many. Whether a particular father's conduct amounts to abandonment, and how he must be given notice of the case, depends on your facts. The court clerk or an attorney can advise you on that specific issue, especially if he might contest the adoption or you don't know where he is.

Your child's consent: If your stepchild is older than 12, the child's written consent is also required (M.G.L. c. 210 § 2).

Home study: The home study is waived for stepparent adoptions in Massachusetts (M.G.L. c. 210 § 5A), so you won't need to arrange one.

Timeline and costs:

  • A stepparent adoption in Massachusetts typically takes about 3-6 months.
  • A father abroad may affect how long notice or consent takes. The clerk can tell you what to expect for his country.
  • Court filing fees vary, so confirm the current amount with the Probate and Family Court clerk in your county.
