How do I serve adoption papers on a parent in a foreign country from Louisiana?

3 min readHelping families since 2001Louisiana

You serve a parent who lives abroad by following the service methods Louisiana's District Court allows: personal service, or service by publication if you truly cannot find the parent's location after due diligence. The details depend on the country and on whether you know where the parent is.

Start with what you know. The first question is whether you have a current address for the parent. The answer decides which path fits your case.

  • You know where the parent is. Louisiana allows personal service, which means the papers are formally delivered to the parent. Inside Louisiana this is usually done by the sheriff. For a parent in another country, the right way to deliver the papers depends on that country and on the court's requirements. The District Court clerk in your parish, or an attorney, can tell you which method the judge will accept for that location.
  • You do not know where the parent is. Louisiana allows service by publication if the location is unknown, but only after due diligence. Due diligence means you made real, documented efforts to find the parent, such as contacting relatives, checking old addresses and trying known email or social media accounts. Keep a record of each step, because you will need to show the court what you tried.

Why the parent's whereabouts matter. Under Louisiana's Children's Code Title XII, a parent's absence can also bear on the case itself. The abandonment period is six months under La. Ch.C. Art. 1245. How that applies to a parent overseas depends on the facts of your situation, such as contact and support. If your case is contested, or the parent may object, talk with an attorney about that issue.

Details to confirm with the clerk. Our information does not cover several things that matter for overseas service: how long foreign service will take, what translation or paperwork a particular country requires, and what newspaper publication will cost. The District Court clerk in your parish can confirm these. Ask before you pay for anything, so you do not spend money on a method the judge will not accept.

What the rest of the process looks like. Louisiana has no minimum residency period for stepparent adoption, though you must be domiciled in the state (La. Ch.C. Art. 1180). Court filing fees typically run $200-$400, and the whole process often takes 3-6 months. Proper service on the other parent is one step along the way, and a delay there can lengthen that timeline. The home study is waived under La. Ch.C. Art. 1252(A).
