Can my spouse adopt my child from a previous relationship in Nevada?

Yes, in Nevada your spouse can adopt your child from a previous relationship, and this kind of adoption is handled through the District Court in your county. Here is how the main pieces work.

Where you file. Stepparent adoptions go through the District Court. Nevada's adoption laws are collected in Nevada Revised Statutes Chapter 127. The court clerk in your county can tell you about local filing procedures and the current filing fee.

Residency. Nevada has no minimum residency period for this adoption (NRS 127D.120(1)). You do not have to wait a set number of months before filing.

The other biological parent. This is usually the most important question in a stepparent adoption. Nevada sets a 6-month abandonment period (NRS § 128.012), and termination of parental rights is a separate step from the adoption itself. If the other parent is involved, absent, or unknown, the right path depends on your facts. Please confirm it with the District Court clerk or an attorney who can look at your situation.

Your child's consent. In Nevada the child's consent age is 14 (NRS 127D.110(1)(c)). If your child is 14 or older, plan for that consent as part of the process.

Home study. A home study is waived for stepparent adoptions in Nevada (NRS chapter 127D). That removes a step that can add time in other types of adoption.

Age difference. For a child, the adopting person must be at least 10 years older than the child (NRS 127C.210(1)(b)). The court may disregard the ages if the adopter is a relative within the third degree and it is in the child's best interest (NRS 127C.210(1)(b), (2)). If you are unsure how this applies to your family, ask the court clerk.

If your child is already an adult. Nevada has a separate adult adoption process (NRS 127C.700). The adopter must be at least 10 years older than the adult being adopted. Both people sign a written agreement, and the court approves it by order. Adult adoptions typically take 4-8 weeks.

Timeline. A stepparent adoption of a minor child in Nevada typically takes 3-6 months, depending on the court's schedule and whether anything is contested.

What this means for you. If you and your spouse are on the same page, the other parent's situation is clear, and your child's consent (if 14 or older) is in order, Nevada has a straightforward path for a stepparent adoption. If the other parent is likely to object, can't be found, or you aren't sure whether the abandonment period applies, get advice on that specific issue before you file.
