Can I claim my stepchild as a dependent before or after adoption?

You may be able to claim your stepchild before adoption as well as afterward. Adoption alone does not decide federal dependent eligibility. The IRS includes both stepchildren and adopted children in its qualifying-child relationship test.

Check eligibility for the particular tax year. You still need to consider the age, residence, support, joint-return and general dependent rules. For the qualifying-child support test, the question is whether the child provided more than half of their own support; it is not a universal requirement that the stepparent personally pay more than half. An older child may require a different analysis. IRS Publication 501 explains these tests and exceptions.

Check who can claim the child. If parents live apart, or more than one person could claim the same child, review the IRS custody, release and tiebreaker rules before filing. Tell your tax preparer about any existing agreement, prior return or change in the child's living arrangements. Do not assume the adoption order settles every tax issue.

Keep these questions separate:

  • Dependent eligibility: does the child meet the applicable IRS tests?
  • A particular credit: does your household meet that credit's additional requirements?
  • Adoption expenses: adopting your spouse's child does not qualify for the federal adoption credit. Read the stepparent adoption tax-credit answer.

Prepare for a tax-preparer conversation. Bring the relevant tax-year records, the child's identifying information, residence and support records, and any adoption or custody documents. Ask which dependent rules apply and whether any separate credit is available. State tax questions need a separate check with that state's tax agency or your preparer.
