Can I attend the adoption hearing virtually in Maine?

3 min readHelping families since 2001Maine

You may be able to, but whether a virtual appearance is allowed is decided by the Probate Court in your county, so confirm with that clerk before you plan around it. Maine has 16 counties, and each has its own Probate Court. The clerk in your county can tell you whether your hearing can be held by video, by phone, or only in person.

What to ask the clerk: A few questions will get you a clear answer quickly.

  • Does the court allow you, as the adopting stepparent, to appear remotely for the finalization hearing?
  • Does your spouse, the child's parent, also need to attend, and can they appear remotely too?
  • Is a written request needed to appear remotely, and what form does it take?
  • If remote appearance is allowed, which platform or phone setup does the court use?

If your child is 12 or older: Under 18-C M.R.S. § 9-302, a child who is 12 or older has a consent role in the adoption. Ask the clerk whether the court expects the child to attend in person or whether a remote appearance would work. The answer can depend on the court and the judge, so get it directly from the clerk.

Why distance may matter less in Maine: There is no minimum residency period before you can file (18-C M.R.S. § 9-301). Maine also waives the home study (18-C M.R.S. § 9-304), so there are fewer steps, such as home visits, that would bring you to the court before the hearing. The hearing itself is the main moment when the court may expect you to be present. If you live far from the county where you file, or have work or military obligations, ask about remote options early.

Timing: A stepparent adoption in Maine typically takes about 3-6 months. Asking about the hearing format when you file gives you time to arrange travel or request a remote appearance.

Our suggestion: If in-person is possible for you, many families value being in the courtroom for the finalization, which is a milestone for your whole family. If it is not possible, ask the clerk about your options. Whatever format the court approves, the hearing is where the judge finalizes the adoption.

Contested or unusual situations: If the other parent has not consented, cannot be found, or is contesting the adoption, the hearing may look different, and the court may have its own requirements about who must attend and how. Those questions depend on your specific facts, so please talk with the Probate Court clerk or an attorney about your situation.
