Can I adopt my stepchild who was born in another country in Ohio?

Yes, you can file a stepparent adoption petition in Ohio for a stepchild born in another country. The petition goes to the Probate Court, and the steps follow Ohio Revised Code Chapter 3107. Where your child was born mostly affects the paperwork, not the basic Ohio process.

What stays the same

  • Court: The case is filed in the Probate Court. You can file in the county where you, your stepchild or the child's parent lives when you file (ORC § 3107.04).
  • Residency: Ohio has no minimum residency period, so a recent move to Ohio does not hold you back (ORC § 3107.04).
  • Child's consent: A child who is 12 or older must give consent (ORC § 3107.06).
  • The other parent: Their consent or abandonment still matters. Ohio's abandonment period is 12 months (ORC § 3107.07).
  • Home study: Ohio does not waive the home study for stepparent adoptions (ORC § 3107.031).
  • Hearing: Ohio requires a brief court appearance to finalize.
  • Timeline: Stepparent adoptions typically take 3-6 months.
  • Court costs: Filing fees typically run $200-$500, depending on the county.

What a foreign birth can change

  • Documents: You will probably need the child's foreign birth record. Ask the Probate Court clerk in your county whether it must be accompanied by an official English translation and what else the court wants to see.
  • Birth certificate after adoption: Ask the Ohio Department of Health Office of Vital Statistics how a record is handled after a foreign-born child's adoption. Your adoption decree is the court's legal order.
  • Immigration or citizenship: Ohio adoption law does not answer these questions. If your stepchild's immigration status or citizenship is involved, talk with an immigration attorney before you file.

When the other parent is abroad or can't be found

The other parent may live in another country, or you may not know where they are. Ohio has procedures for cases where a parent cannot be found. How they apply to a parent overseas depends on your facts, so ask the clerk or an attorney about that. If the other parent might contest the adoption, an attorney can advise you on your situation.
