Can I adopt my stepchild in Kentucky if I was previously married to someone else?

Yes. Kentucky's requirements for adopting your stepchild don't mention previous marriages. They focus on your age, where you live, your current marriage to the child's parent, and the required consents. If you want to know how a Circuit Court views a particular marital history, the Circuit Court clerk in your county or an attorney can confirm it.

What Kentucky does look at:

  • Your age: a petitioner must be 18 or older (KRS § 199.470).
  • Your spouse: a petitioner's spouse must join the petition unless the spouse is the child's biological parent. As a stepparent married to the child's parent, that exception is the one that applies to you. Your spouse's consent to the adoption is also part of the paperwork.
  • Residency: there is no waiting period for Kentucky residents. Non-residents need 12 months in the state (KRS § 199.470).
  • Court: the case is filed in the Circuit Court of your county.
  • Background check: Kentucky requires criminal background checks through the Kentucky State Police for adoption petitioners.
  • Home study: it is waived for stepparent adoptions (KRS § 199.473).

If your former spouse is the child's other parent: this is where your earlier marriage can matter in practice, because the other parent's consent becomes the main question. Kentucky's paperwork includes consent forms, or a motion to dispense with consent. Ninety days (3 months) of no contact can establish grounds for proceeding (KRS § 199.502). If the child is 12 or older, the child's consent is part of the process (KRS § 199.500). If the other parent is contesting the adoption, or you aren't sure how consent applies to your family, ask the court clerk or an attorney about that specific issue.

If you don't know where the other parent is: Kentucky allows service by publication if the location is unknown, after diligent efforts to find the parent. Otherwise, service can be made personally by a sheriff or process server.

Cost and timeline: court filing fees typically run $150-$300, and the total cost is typically under $1,000, compared with $3,000-$5,000+ for an attorney. A stepparent adoption in Kentucky typically takes 3-6 months.
