Yes, a prior termination of the other parent's rights does not stop you from asking the New Jersey Superior Court to approve a stepparent adoption. You file your petition in the Superior Court in your county, and the earlier termination order is an important part of your case.
What a prior termination changes. In New Jersey, abandonment is one way a case can proceed without the other parent's agreement. The abandonment period is six months under N.J.S.A. § 9:3-46. If a court has already ended the parent's rights, you are in a different position from a family that has to prove abandonment. How the Superior Court handles consent, notice to the former parent, or abandonment papers after a prior termination depends on your case. Please confirm those points with the Superior Court clerk in your county or with an attorney. Keep a certified copy of the termination order and the case number where you can find them.
What stays the same:
- Residency: New Jersey has no minimum residency period (N.J.S.A. § 9:3-42).
- Home study: It is waived for stepparent adoptions (N.J.S.A. § 9:3-48).
- The child's role: New Jersey does not require the child's consent. A child 10 or older attends the final hearing, and the court considers the child's wishes (N.J.S.A. § 9:3-49).
- Where you file: The Superior Court in your county. New Jersey has 21 counties, and each clerk's office can tell you how local filing works.
Timeline and court costs. Stepparent adoptions in New Jersey typically take 3-6 months. Whether a prior termination shortens that for your family depends on your case and your county's schedule, so ask the clerk. The court filing fee generally runs $200-$350, and the total typical cost is under $1,000. Attorney representation for a stepparent adoption often runs $3,000-$5,000+.
When to get individualized help. Some situations turn on specific facts, and a clerk or an attorney is the right person to ask:
- The termination order came from a different kind of case, such as a prior adoption attempt, and you're unsure how it applies.
- There is another legal parent or someone else whose rights might matter.
- Anyone is likely to contest the adoption.
- You aren't sure the termination order is final or complete.
Our service is for families who have these facts settled and want a clean, accurate filing. It does not replace legal advice about unusual circumstances.
