Are there any special requirements for adoption in New Jersey?

Yes. New Jersey adoptions go through the Superior Court in your county, and a stepparent adoption has a few requirements and options that are specific to the state.

Where you file. Stepparent adoptions are filed in the Superior Court. New Jersey has 21 counties, and the clerk in your county can tell you about local filing details and forms.

Residency. New Jersey sets no minimum residency period (N.J.S.A. § 9:3-42), so you do not have to wait before filing.

Your child's role. New Jersey does not require the child's consent (N.J.S.A. § 9:3-49). A child who is 10 or older attends the final hearing, and the court considers the child's wishes.

Home study. A home study is waived for stepparent adoptions (N.J.S.A. § 9:3-48). That removes a step that can add time and cost in other situations.

Adopter age. The adopting parent must generally be at least 18, and the court may waive this for good cause (N.J.S.A. 9:3-43(b)).
