Can I adopt my stepchild if the biological parent is mentally incapacitated in Massachusetts?

You can bring a stepparent adoption petition in the Massachusetts Probate and Family Court, but how a parent's mental incapacity affects consent is a point to confirm with the Probate and Family Court clerk in your county or a Massachusetts family law attorney. Here are the Massachusetts rules that apply to your situation.

Consent of the lawful parents. M.G.L. c. 210 § 2 calls for the written consent of the child's lawful parents. Whether a guardian, conservator or other representative has a role when a parent is incapacitated depends on your family's facts. The clerk or an attorney can tell you how it works in your case.

Your stepchild's consent. Under M.G.L. c. 210 § 2, a child above age 12 must give written consent to the adoption.

Abandonment. Massachusetts sets no fixed number of months for abandonment. Under M.G.L. c. 210 § 3, it depends on the parent's overall conduct. Whether and how a parent's incapacity bears on that question is best raised with an attorney, especially if anyone may contest the case.

Residency. Massachusetts has no minimum residency period under M.G.L. c. 210 § 1, so there is no waiting period before you file.

Home study. The home study is waived in a stepparent adoption under M.G.L. c. 210 § 5A.

Timeline. A stepparent adoption in Massachusetts usually takes 3-6 months. The clerk can tell you what to expect if your case has added steps.

Documents worth gathering. These may be useful when you speak with the clerk or an attorney:

  • Any court orders about guardianship or conservatorship for the parent
  • Medical or other documentation of the parent's condition
  • Records of the parent's contact with and support of your stepchild

When to get individual legal help. If the biological parent's whereabouts are unknown, if a guardian is involved, or if someone may oppose the adoption, a Massachusetts family law attorney can advise you on that specific issue. The Probate and Family Court clerk can also answer questions about local filing steps and fees.
