Can I adopt my stepchild if the biological parent is a drug addict in Massachusetts?

Yes, you can ask the Massachusetts Probate and Family Court to approve a stepparent adoption even if your stepchild's other biological parent struggles with drug addiction, but the way forward depends on that parent's consent and on the facts of your situation. Addiction by itself is not something this page can say settles the question, so the useful issue is what the parent's actual involvement with your child looks like.

Consent is the starting point. Under M.G.L. c. 210 § 2, the written consent of the child's lawful parents is required, along with the child's own written consent if the child is above age 12. Some parents who are struggling recognize they cannot parent right now and agree to the adoption. If the parent will sign, the process is usually simpler.

If the parent will not consent, abandonment may matter. Massachusetts sets no fixed number of months for abandonment. Under M.G.L. c. 210 § 3, it depends on the parent's overall conduct. Courts look at the whole picture rather than a calendar count, so a parent's addiction is not automatically treated as abandonment, and a gap in contact is not automatically treated as one either. Whether your facts meet that standard is a question for an attorney or the Probate and Family Court clerk, especially if the parent objects.

What helps to gather:

  • Dates and details of the parent's contact, or lack of it, with your stepchild
  • Any attempts you or your spouse made to keep the parent involved
  • Whether the parent has provided support or taken part in the child's life
  • A clear picture of the stable home you and your spouse provide

Other Massachusetts basics:

  • Court: The petition goes to the Probate and Family Court. The state has 14 counties, and the clerk in your county can answer questions about local filing steps and fees.
  • Residency: There is no minimum residency period (M.G.L. c. 210 § 1).
  • Home study: It is waived in stepparent adoptions (M.G.L. c. 210 § 5A).
  • Timeline: Stepparent adoptions in Massachusetts typically take about 3-6 months.

When to get individual advice: If the other parent is likely to contest the adoption, cannot be located, or has a court history involving your child, talk with a Massachusetts family law attorney about your specific facts. The court clerk can confirm procedural details, but cannot advise you on your case.
