Can I adopt my stepchild if the biological parent is a drug addict in Kentucky?

Yes. You can ask a Kentucky Circuit Court to approve a stepparent adoption when your stepchild's biological parent is struggling with drug addiction, but the case still has to rest on that parent's consent or on grounds the court accepts, such as abandonment.

Why the focus is on consent or abandonment: The addiction itself is not what you file on. What matters is which path applies to your family:

  • Consent: Some parents who know they cannot parent right now agree to the adoption. In that case you file the Petition for Adoption along with the parent's consent form.
  • Abandonment: Kentucky has one of the shorter abandonment periods. Just 90 days (three months) of no contact can establish grounds to proceed (KRS § 199.502). If the parent has been out of the picture because of addiction, that no-contact period is what you would document.
  • No consent and no abandonment: If the parent objects, or the facts do not fit neatly, you would file a motion to dispense with consent. How a judge treats addiction in that situation depends on the facts, so talk to a Kentucky family law attorney or the Circuit Court clerk in your county about that specific issue.

What to gather:

  • Dates and details of the parent's absence or missed contact
  • Any attempts the parent made, or did not make, to stay in the child's life
  • Your spouse's consent to the adoption
  • The child's consent if your stepchild is 12 or older (KRS § 199.500)

Finding the parent: If the parent has to be notified, Kentucky allows personal service by a sheriff or process server. If you truly do not know where the parent is, service by publication is allowed after diligent efforts to find them.

Other Kentucky requirements:

  • Residency: There is no waiting period for Kentucky residents (KRS § 199.470). Non-residents need 12 months in the state.
  • Home study: It is waived in stepparent adoptions (KRS § 199.473).
  • Background checks: Petitioners need criminal background checks through the Kentucky State Police.
  • Timeline: Stepparent adoptions typically take 3-6 months.
  • Cost: Court filing fees run about $150-$300, and the total is typically under $1,000, compared with $3,000-$5,000+ for an attorney.

A parent's addiction can make a case emotionally heavy, but the paperwork is still the same: a clear petition, the right consent documents or motion, and proof of service. If the parent is likely to fight the adoption, an attorney can advise you on that.
