Yes, a stepparent can pursue adoption in Kentucky when the other biological parent has a mental illness. The path depends on whether that parent consents and how involved they have been, and how the Circuit Court weighs mental health in your particular situation is something to confirm with the Circuit Court clerk in your county or a Kentucky family law attorney.
Where the process starts: Your petition is filed in the Circuit Court. Kentucky has no waiting period for residents. Non-residents need 12 months in the state under KRS § 199.470. Typical timelines run 3-6 months.
If the parent is willing to consent:
- Your paperwork includes the Petition for Adoption, consent forms, and your spouse's consent to the adoption.
- If your child is 12 or older, the child's consent also comes into play under KRS § 199.500.
If the parent will not or cannot consent:
- Kentucky lets you file a motion to dispense with consent instead of consent forms.
- Kentucky has one of the shorter abandonment periods. Three months (90 days) of no contact can establish grounds for proceeding under KRS § 199.502.
- Whether a parent's illness changes how the court views a gap in contact depends on the facts. Ask an attorney about that specific issue.
- If the parent is under a guardianship or is otherwise unable to take part, the details matter. An attorney or the clerk can tell you how the court handles that.
Notifying the parent: The other parent must be given notice of the case. Kentucky allows personal service by a sheriff or process server. If you do not know where the parent is, service by publication is available after you have made a diligent search. The clerk can explain the steps.
Other requirements that still apply:
- Criminal background checks through the Kentucky State Police for the adoption petitioners.
- The home study is waived under KRS § 199.473.
Costs: Court filing fees typically run $150-$300. The total cost of a stepparent adoption you file yourself is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney.
When to bring in an attorney: If the other parent contests the adoption, has a guardian, or you are unsure whether they can understand or respond to the case, a short consultation with a Kentucky family law attorney can be worthwhile. You can still prepare your court documents separately.
