Can I adopt my stepchild if the biological father lives in another country and we live in Ohio?

Yes, you can file a stepparent adoption in Ohio's Probate Court even though your stepchild's biological father lives in another country. His location affects how he is notified and whether his consent is needed, but those details depend on your facts.

Where you file: Stepparent adoptions in Ohio are handled by the Probate Court in one of Ohio's 88 counties. Ohio has no minimum residency period for adoption (ORC § 3107.04), so a recent move to Ohio does not hold you back. The clerk of the Probate Court in your county can confirm the right county for your filing.

Does he have to consent? Not always. Ohio looks at whether a parent has abandoned the child. Under ORC § 3107.07, the period is 12 months, and it concerns a parent who has failed to maintain meaningful contact or support. Living abroad does not change that question. The court asks what contact and support actually happened.

  • If he is willing: He may be able to give his consent. How a consent signed in another country must be signed or verified for an Ohio court is something the Probate Court clerk can confirm.
  • If he has not been in the child's life for 12 months or more: Abandonment may apply, but the court decides based on the evidence, such as calls, letters, visits and support.
  • If he objects: A contested case depends heavily on the facts. Talk with an Ohio adoption attorney about that specific issue.
  • If you don't know where he is: Ohio has procedures for cases where a biological parent cannot be found. The clerk or an attorney can tell you which steps apply to you.

Notifying a parent overseas: The rules for formally notifying a parent in another country, and how much time that might add, are not something we can estimate here. Ask the Probate Court clerk in your county, or an attorney, how notice must be handled for his country.

Home study: In Ohio, a home study is not waived for stepparent adoptions. It falls under ORC § 3107.031, so plan for it.

Timeline and cost:

  • Stepparent adoptions in Ohio typically take 3-6 months. A father abroad could affect that, and the clerk can tell you whether it will in your case.
  • Court filing fees run about $200-$500, depending on the county.
  • Ohio requires a brief court appearance to finalize a stepparent adoption.

What to gather now: Write down the father's last known address and country. Also collect anything that shows the last time he contacted or supported your child, such as messages, emails, money transfers or cards. Even if he never responds, this record helps the court understand your situation.
