Can I adopt my stepchild if the bio father is in prison for a long sentence in Alaska?

Possibly yes, but it depends on the facts. A biological father's prison sentence does not by itself stop a stepparent adoption in Alaska, and his incarceration does not automatically decide the case either. What matters is his contact with your child and whether he consents. A few Alaska facts apply to your situation.

Where the case is filed: Your petition goes to the Superior Court. Alaska has no minimum residency period before you can file.

Abandonment and the father's rights: Alaska's abandonment provision, Alaska Stat. § 25.23.050(a)(1)-(2), uses a period of 6 months. Whether a parent's time in prison counts as abandonment, and how a judge weighs a long sentence, depends on the details of your case. That includes his contact, support, and communication with your child. Please confirm this point with the Superior Court clerk in your borough or with an adoption attorney. In Alaska, termination of parental rights is not a separate proceeding in a stepparent adoption.

If he is willing to consent: Many families find the process simpler when the father agrees. Whether his consent is required in your situation, and how it must be signed while he is in prison, are questions for the clerk or an attorney. If he does not consent, or if you expect him to contest, an attorney can advise you on that specific issue.

Your child's consent: If your stepchild is 10 or older, your child's consent is part of the process under Alaska Stat. § 25.23.040.

Home study: Alaska waives the home study for stepparent adoptions under Alaska Stat. § 25.23.100. That means one less step, and no home visits to schedule.

Notice to the father: The father will need to receive notice of the case. The exact way to deliver papers to someone in a correctional facility, and any response deadline, should be confirmed with the Superior Court clerk. Facilities and courts can have their own procedures.

Timeline: Stepparent adoptions in Alaska typically take 3-6 months. A contested case or difficulty reaching the father could change that. Court filing fees are set by the court, so ask the clerk for the current amount.

What to do next:

  • Gather any records of the father's contact or support, or the lack of it, and any letters or messages.
  • Note the facility where he is held and his sentence, if you know them.
  • Ask the clerk in your borough how the court wants a parent in custody to be notified.
  • Talk with an attorney if you expect him to oppose the adoption.
  • After the adoption is final, a new birth certificate is handled through the Alaska Bureau of Vital Statistics.
