Yes, you can petition to adopt your stepchild in Texas, and a child's special needs do not keep you from starting. Texas Family Code § 162.001(a) says an adult may petition to adopt a child, subject to standing requirements. Because every family's situation is different, ask the District Court clerk in your county, or an attorney, how your child's particular diagnosis or disability affects any step.

Where you file: Your petition goes to the District Court in your Texas county. The state has 254 counties, and each clerk's office can tell you its local filing procedures.

Why many parents pursue it:

  • Full parental rights and responsibilities
  • Medical decision-making authority, which matters when a child has ongoing care needs
  • Inheritance rights from you
  • Social Security and insurance benefits
  • A name change, if you want one, included in the adoption process

Consent and the other parent: The other legal parent's role is often the biggest question. Texas looks at abandonment under Tex. Fam. Code § 161.001. That includes a parent who has failed to support the child for at least six months, or who has failed to maintain contact for one year or more. Occasional child support payments alone do not prevent an abandonment finding, and token contact does not either. Courts look at the whole relationship, including emotional support and involvement. If the other parent is contesting, or you don't know where they are, talk to an attorney or the District Court clerk about your specific facts.

Your child's consent: Texas sets the child consent age at 12 (Tex. Fam. Code § 162.010). If your child is 12 or older, this applies. If a disability affects how your child can understand or give consent, ask the clerk or an attorney how the court handles that.

Home study: A home study is waived in Texas stepparent adoptions (Tex. Fam. Code § 107.153(a-1)). That saves time and expense.

Benefits your child already receives: If your child receives SSI, Medicaid, or other disability-related coverage, review how an adoption could affect it before you file. The Social Security Administration and the agency that provides the coverage can answer that for your situation.

Timeline and cost: A Texas stepparent adoption typically takes about 3 months.
