Can I adopt my special needs stepchild in Ohio?

Yes, you can ask the Ohio Probate Court to approve a stepparent adoption of your special needs stepchild. Ohio's adoption law is in Ohio Revised Code Chapter 3107, and the petition is filed in the Probate Court in your county. The data we work from doesn't describe a separate process for children with special needs, so the steps below are the ones that apply to stepparent adoptions in general.

If your stepchild is a minor:

  • Court: You file in the Probate Court. Ohio has 88 counties, and each has its own court.
  • Residency: Ohio has no minimum residency period (ORC § 3107.04), so a recent move does not hold you back.
  • Your child's consent: Consent is required from a child who is 12 or older (ORC § 3107.06). If your child's disability affects their ability to give consent, ask the Probate Court clerk or an attorney how that is handled. That answer depends on your child's situation.
  • The other parent: If the other parent has not consented, the abandonment period in Ohio is 12 months (ORC § 3107.07). Whether it applies to your family depends on the facts, so an attorney or the clerk can advise you on a contested case or a parent you cannot locate.
  • Home study: A home study is part of the minor adoption process (ORC § 3107.031). The court can tell you what your county expects.
  • Timeline: Stepparent adoptions in Ohio typically take 3-6 months.
  • Court appearance: Ohio requires a brief court appearance for finalization.

If your stepchild is an adult with a disability:

Special needs often continue past age 18, and Ohio does permit adult adoption in limited situations. Two of them are when the adult is totally or permanently disabled and when the adult has a developmental disability. Another is when the adult is the child of your spouse and consents. Ohio does not have a general category for adopting a relative.

  • Consent: The adult must consent in the stepchild situation. For the disability situations, Ohio law on whether the adult's consent is required should be confirmed with the Probate Court clerk or an attorney.
  • Hearing: A hearing is required. You and the adult must appear unless the court excuses it for good cause.
  • Timeline: Adult adoptions typically take 4-8 weeks.

Costs and benefits:

Court filing fees in Ohio run $200-$500, and the total cost is typically under $1,000, compared with $3,000-$5,000+ for an attorney. Adoption can bring decision-making authority, Social Security and insurance benefits, and family security. If your child receives disability benefits or Medicaid, check with the agency that provides them, or an attorney, before filing, because that depends on your child's specific benefits.
