A California stepparent may be able to adopt an adult stepchild. The starting questions are whether both people are adults, whether the adopting parent is older, whether they agree to the legal parent-child relationship, and whether all applicable consent and court requirements can be met.
Check eligibility before preparing the packet
| Question | Why it matters |
|---|---|
| Who will be the parent? | The adopting adult becomes the legal parent; the adopted adult becomes the legal child. |
| Is the adopting adult older? | California's adult-adoption guidance requires this age relationship. |
| Does each person agree? | Both sign an agreement accepting the parent-child relationship. |
| Are either of you married or partnered? | Identify applicable spouse or domestic-partner consent requirements and any exception that needs proof. |
| Have there been previous adult adoptions? | Recent unrelated-adult adoptions can require a separate review of the statutory limits. |
California Courts' guide describes adult adoption for people 18 or older, including stepparent relationships. Being an adult does not by itself establish that every other requirement is satisfied. This guide addresses adult stepchildren; an under-18 case has different legal questions.
Explain the relationship in your own facts
Prepare the dates and facts that explain how the stepparent relationship developed: how long you have known each other, how you are related, and why you want the adoption. Keep the explanation accurate and consistent with the petition. Do not substitute a generic story or an assumed length of parenting for your own history.
The judge makes the approval decision. Family Code section 9328 directs the court to consider the parties' best interests and the public interest. Completed forms and a meaningful family relationship are not an approval guarantee.
Review previous adoptions when relevant
Section 9303 sets one-year restrictions involving unrelated-adult adoptions by the prospective parent or their spouse. It includes stated exceptions and a court finding of good cause. Tell the preparer about previous adult adoptions, their dates and the relationships involved; do not assume an exception applies without reviewing it.
Choose the right next step
If the family is ready to proceed, continue with the California process guide and gather the information its document checklist identifies. If the adoption's purpose includes inheritance, support or caregiving, obtain advice about those particular consequences before relying on the order to accomplish every planning goal. Adult adoption establishes a legal family relationship; the state court guide recommends legal advice about its practical effects.
