Can an elderly stepparent adopt in Nebraska?

3 min readHelping families since 2001Nebraska

Yes. An older stepparent can adopt in Nebraska. The adoption statute, Neb. Rev. Stat. § 43-101, says "any adult person" may adopt a minor child, and we found no adoption-specific minimum age or age gap in the statute. If you have a question about how age might matter in your particular case, the County Court clerk in your county can confirm it.

Adopting an adult stepchild: This is where many older stepparents file. Nebraska allows an adult child to be adopted by the spouse of the adult child's parent. Here is how it works:

  • Court: You file in the County Court of the county where you live.
  • Your spouse joins: A person with a spouse cannot adopt unless the spouse joins the petition. That means the adult child's parent signs on with you.
  • Home study: An adult adoption is exempt from a home study unless the court specifically orders one (Neb. Rev. Stat. § 43-107). The court may still order a home study or background investigation if it believes that serves everyone involved.
  • Residency: Nebraska sets no minimum residency period for adoption (Neb. Rev. Stat. § 43-102). The requirement that a child live with the petitioner for six months before the decree does not apply to an adult child.
  • Hearing: A hearing is required, usually held 4 to 8 weeks after filing unless it is continued. You will need to appear in person.
  • Limit on parents: No adoption may result in more than two legal parents.

Adopting a minor stepchild: An older stepparent follows the same steps as any other stepparent.

  • A child over 14 must consent (Neb. Rev. Stat. § 43-104).
  • A biological parent's rights must be addressed, either through consent or, in an abandonment situation, a period of 6 months. If the other parent is unknown, missing, or contesting, ask the court clerk or an attorney about your specific situation.
  • A home study is waived for stepparent adoptions (Neb. Rev. Stat. § 43-107).
  • Stepparent adoptions of minors typically take 3-6 months, compared with 4-8 weeks for adults.

What the law doesn't spell out: We found no provision in the Nebraska statutes requiring the adult adoptee's own written consent. Because the adult child's agreement is still central to the process, ask the County Court clerk how your county handles it.

Why families do it later in life: Adoption creates a legal parent-child relationship. For many families, that formalizes a bond that has lasted for years.

Cost: Court filing fees in Nebraska generally run $100-$250. A do-it-yourself adoption typically totals under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Your clerk can confirm the exact fee in your county.
