Yes, a stepfather can adopt his wife's child in Colorado. The adoption is filed in the District Court, and it is the situation stepparent adoption is meant for. Here is what to know as you plan.

Who can adopt. A petitioner must be 21 or older (C.R.S. § 19-5-202). A married petitioner generally files jointly with his spouse unless the spouse is the child's natural or adoptive parent. Because your wife is the child's mother, that exception is the one that fits your family. If your situation is unusual, the District Court clerk can confirm how it applies.

Residency. Colorado sets no minimum residency period before you can file (C.R.S. §§ 19-5-201, 19-5-204). The District Court clerk in your county can tell you where your petition should be filed.

The other biological parent. The child's father is typically part of the process. The consent rules and the abandonment ground are in C.R.S. § 19-5-203. Under the abandonment provision (C.R.S. § 19-5-203(1)(d)(II)), the period is 12 months. If the father is missing, objects, or his situation is disputed, the outcome depends on your specific facts. In that case, ask the District Court clerk or an attorney about your particular circumstances.

The child's consent. A child who is 12 or older must consent to their own adoption (C.R.S. § 19-5-203). Younger children do not have this consent requirement.

Home study. Colorado does not require a home study for stepparent adoptions (C.R.S. § 19-5-209(1)). That removes a step that can add time and expense in other places.

Timeline. Stepparent adoptions in Colorado typically take 3-6 months from filing to finalization.

Name change. If you and your family want the child's last name to change, Colorado allows that as part of the adoption at no additional cost.

What it costs.

  • Court filing fees run about $200-$500, depending on the county.
  • Attorneys commonly charge $3,000-$5,000+.
  • Using a document preparation service and filing yourself, the total is typically under $1,000.

Why families do it. Adoption establishes inheritance rights, gives you medical decision-making authority, and opens up Social Security and insurance benefits for your stepchild. It also ends any child support obligation of the other parent.
