Can a non-citizen adopt a stepchild in Ohio?

Whether your citizenship or immigration status affects your ability to adopt your stepchild in Ohio is something to confirm with the Probate Court clerk in your county or an attorney. The Ohio adoption rules we can point to for stepparents deal with your age, the Probate Court process, consents and the paperwork, and they don't turn on citizenship. How your particular status is treated is a fact-specific question, so get a direct answer before you file. An immigration attorney can also tell you how an adoption relates to your own immigration situation.

What Ohio does set out for adopters:

  • Court: Stepparent adoptions are filed in the Probate Court of the county where you file. Ohio has 88 counties, and the clerk can tell you what that court asks for.
  • Age: An unmarried adopter must be 18 or older. A married couple adopting together needs only one spouse to be an adult.
  • Residency: Ohio has no minimum residency period (ORC § 3107.04). Families who have recently moved to Ohio can still file.
  • Child's consent: Ohio sets a child consent age of 12 (ORC § 3107.06).
  • Other parent's consent: If the other biological parent has not had meaningful contact or provided support for 12 months, abandonment may apply (ORC § 3107.07). If that parent contests the adoption, or you don't know where they are, talk to the court clerk or an attorney about your specific situation. Ohio has procedures for cases where a parent cannot be found.

Home study and hearing:

  • Home study: Ohio does not waive the home study for stepparent adoptions (ORC § 3107.031). Ask the clerk how it works in your county.
  • Court appearance: A brief court appearance is required to finalize a stepparent adoption.

Timeline and cost:

  • Timeline: Stepparent adoptions in Ohio typically take 3-6 months.
  • Court filing fees: These typically run $200-$500, set by the court. Total costs usually stay under $1,000, compared with $3,000-$5,000+ for an attorney.

Questions to ask the clerk or an attorney before you file:

  • Does the court want any documentation related to your immigration status or identity?
  • Does your history or background raise anything the court will want to review?
  • Is the other parent's consent needed, or does abandonment apply in your case?
