At what age does my child need to consent to adoption in New Jersey?

3 min readHelping families since 2001New Jersey

New Jersey does not require your child's consent to a stepparent adoption at any age. A child who is 10 or older attends the final hearing, and the court considers the child's wishes (N.J.S.A. § 9:3-49).

What this means for your family. The law does not set an age at which your child has to sign or formally agree. A child's feelings still count. If your child is 10 or older, the judge will take their wishes into account at the final hearing, so they should expect to be there.

Before the hearing. You can help your child feel comfortable in a few ways:

  • Explain in simple terms what adoption means and why you are doing it.
  • Tell them the hearing is a celebration of your family, and that the judge may want to know how they feel.
  • Let them ask questions, and listen to their answers, including any worries.
  • Tell them what to expect in the courtroom so nothing is a surprise.

If your child is under 10. The information available to us covers children 10 and older. For how the court handles a younger child at the hearing, the Superior Court clerk in your county can confirm the practice. New Jersey has 21 counties, and local courtroom procedures can differ in the details.

If your child is hesitant or opposed. Because a child's wishes are something the court considers, a child who is unsure or unhappy about the adoption can affect how the hearing goes. How the court would weigh that in your situation depends on your facts. If your child has strong objections, talk with an attorney about your specific circumstances.

Where the adoption is filed. Stepparent adoptions are filed in the Superior Court in your county. The court filing fee typically runs $200-$350, and a stepparent adoption in New Jersey typically takes 3-6 months from filing to finalization.

Other people's consent is a separate question. Your child's role is only one part of the process. Whether another person, such as the child's other legal parent, must agree or be notified depends on your family's situation. The Superior Court clerk or an attorney can answer that for your case, especially if the other parent is difficult to reach or may object.
