Are there any special requirements for adoption in Virginia?

Yes. Virginia has a few requirements that stepparents should know about, and the main ones are the Circuit Court filing, the consent rules, and a simplified home-study approach for stepparents.

Where you file: Stepparent adoptions are handled by the Circuit Court. Virginia has 133 counties/cities, and each court clerk's office may have its own local practices, so it helps to prepare your paperwork for your specific locality.

Residency: Virginia has no minimum residency period. Under Va. Code § 63.2-1201, any natural person who resides in the Commonwealth may petition to adopt a minor.

Consent: Your paperwork typically includes a Petition for Adoption, consent forms (or a motion to dispense with consent), and your spouse's consent to the adoption. A child who is 14 or older has a consent role under Va. Code § 63.2-1202. Virginia also sets an abandonment period of 6 months in Va. Code § 63.2-1202(H). Whether that applies depends on the facts of your family, so if the other birth parent is not consenting, ask the Circuit Court clerk or an attorney about your situation.

Home study: Virginia allows abbreviated reviews for stepparents, and the home study is waived for stepparent adoptions under Va. Code § 63.2-1242.

Notice to the other parent: Virginia allows personal service. If a parent's location is unknown, it also allows service by publication after a diligent search. What counts as a diligent search is something to confirm with the clerk or an attorney.

Military parents: Virginia has special provisions for military parents. If one of the parents is in the service, ask the clerk how those provisions apply to your case.

Adult adoption: If the person you want to adopt is 18 or older, the process is different, and it is often faster, at 4-8 weeks. The petitioner must be a resident of Virginia, and the adoptee's consent is required. A stepchild can qualify if the petitioner has stood in loco parentis for at least 3 months (Va. Code Ann. § 63.2-1243). The home study is not made unless the Circuit Court chooses to require one.
