When should I start the stepparent adoption process in South Dakota?

3 min readHelping families since 2001South Dakota

You can start a stepparent adoption in South Dakota as soon as you are ready, because the state has no minimum residency period you must wait out before filing.

Why there is no waiting period to begin. Since South Dakota sets no residency requirement, you don't need to put the process off until you have lived in the state for a set time. The petition goes to the Circuit Court in your county (South Dakota has 66 counties), and the court clerk there can answer questions about local filing steps and the filing fee.

Plan for the timeline. A stepparent adoption in South Dakota typically takes 3-6 months. If you want the adoption finalized before a particular moment, such as a school year, a move, or a medical need, it makes sense to begin well ahead of it.

Gather consents early. These are often what shape your schedule:

  • If the child is 12 or older, the child's consent is part of the process (SDCL § 25-6-5). Talking with an older child early gives them time to understand what is happening.
  • Think early about the other legal parent. If that parent is willing to consent, you can line up their signature up front. If they are not, or can't be found, South Dakota's abandonment period is 6 months (SDCL § 25-6-4(2)). Whether your situation fits depends on specific facts, so ask the Circuit Court clerk or an attorney about that issue before you file.

Home study. South Dakota waives the home study in stepparent cases (SDCL § 25-6-10), so you don't need to schedule one before you file.

Age difference. For a minor child, the adopter must be at least 10 years older than the child unless the court finds the adoption is in the child's best interest (SDCL 25-6-2). If that could apply to you, ask the clerk or an attorney.

If the person you want to adopt is an adult. Adult adoption is usually faster, at about 4-8 weeks. The adoptee must have lived in your home for at least 6 months while under age 21, and this must appear in the petition (SDCL 25-6-18). That requirement is waived if the adoptee is your biological child. If this fits your family, count back from that 6-month mark when you plan.

A simple way to decide. Start now if:

  • you want the legal relationship in place sooner;
  • you have a date you are working toward;
  • you need time to talk with a child, the other parent, or your spouse first.

If your situation is contested, or you don't know where the other parent is, speak with the Circuit Court clerk or an attorney about that specific issue before you build your timeline around it.
