You can start the stepparent adoption process in New Hampshire as soon as you are ready. The state has no minimum residency period you must complete before filing (RSA 170-B:15, I), so there is no waiting period to run out first.
Why starting early helps
- The process takes time. A New Hampshire stepparent adoption typically takes 3-6 months, so starting sooner means your family is legally official sooner.
- No home study. Home studies are waived for stepparent adoptions under RSA § 170-B:18, which removes one step that often slows things down in other places.
- Your Circuit Court. Your case is filed with the Circuit Court in your county. New Hampshire has 10 counties, and the clerk in yours can tell you about local filing details, including the current filing fee.
Timing issues to think about before you file
- Your child's age. New Hampshire sets the child consent age at 14 (RSA 170-B:3, I). If your child is close to 14, plan ahead for how that consent fits into your timeline. The Circuit Court clerk can explain how it works in practice.
- The other parent. Ending the other parent's rights is a separate step in New Hampshire. If the other parent will agree, planning is usually more straightforward. If the other parent has been out of the picture, the law refers to a 6-month abandonment period (RSA § 170-C:5). Whether your situation qualifies depends on your specific facts, so talk to the Circuit Court clerk or an attorney about that issue. The same applies if the other parent is unknown or may contest the adoption.
- Gathering paperwork. Locating records and getting signatures can take longer than filling out forms. Starting early gives you room for that.
Signs that now is a good time
- You are married to the child's parent and everyone in the household is on board.
- You want the legal protection of being recognized as a parent, for example for medical decisions or school matters.
- The other parent's situation is already clear, whether they will consent or have been absent.
- Your child is under 14 and you would like to finish before the consent age comes into play.
If your situation is more complicated, such as a disagreement with the other parent, it still makes sense to learn about the process now. Just have an attorney or the clerk confirm the specific steps for your case.
