What is the fastest way to complete stepparent adoption in Kentucky?

3 min readHelping families since 2001Kentucky

The fastest way to complete a stepparent adoption in Kentucky is to file a complete, correct petition with your county's Circuit Court as early as you can, with every consent and required form ready. Kentucky typically takes 3-6 months, and most delays come from missing paperwork, not from waiting periods.

No residency wait. Kentucky residents have no waiting period (KRS § 199.470). You can file as soon as your paperwork is ready. Non-residents need 12 months in the state first.

Home study. Kentucky waives the home study in stepparent adoptions (KRS § 199.473), which removes a step that can slow things down in other situations.

Get consents signed up front. The petition is usually accompanied by:

  • Petition for Adoption
  • Consent forms from the other legal parent, or a motion to dispense with consent
  • Your spouse's consent to the adoption

If the other parent agrees, having them sign early is the biggest time-saver. Kentucky also sets the child's consent age at 12 (KRS § 199.500), so if your child is 12 or older, plan for that consent too.

If the other parent will not consent. Kentucky has one of the shorter abandonment periods: 90 days (3 months) of no contact can establish grounds to proceed (KRS § 199.502). Whether your situation qualifies depends on your specific facts, so check with the Circuit Court clerk or an attorney. A contested case will generally take longer than an agreed one, and the clerk or an attorney can tell you how the court will handle yours.

Serve the other parent correctly. Kentucky allows personal service by a sheriff or process server. If you do not know where the other parent is, service by publication is allowed after a diligent search. Doing this correctly the first time keeps the case from stalling.

Start the background check early. Kentucky requires criminal background checks through the Kentucky State Police for adoption petitioners. Request yours at the beginning so it is not the last item holding up your filing.

Ask the clerk about hearing dates. The Circuit Court sets its own calendar. Once you file, ask the clerk in your county how soon a hearing can be scheduled and whether anything else is needed. Kentucky has 120 counties, and local procedures can differ a little. After your adoption is final, the Kentucky Office of Vital Statistics is the agency to contact about birth record questions.

Keep costs low. Court filing fees typically run $150-$300, and the total cost is usually under $1,000 when you file without an attorney, compared with $3,000-$5,000+ with one. Confirm the exact fee with your county clerk.

A realistic picture. If the other parent consents and your documents are complete, there is little to slow you down. If consent is contested, or the other parent cannot be located, expect it to take longer and get advice on that specific issue.
