StepParent Adoption 360

What is stepparent adoption?

Stepparent adoption is the legal process by which a stepparent becomes the full legal parent of their spouse's child. It is the most common form of adoption in the United States, according to the U.S. Department of Health and Human Services.

Once finalized, the stepparent has all the same rights and responsibilities as a biological parent — including inheritance rights, medical decision-making authority, custody rights, and the full parent-child legal relationship.

The process requires either consent from the other biological parent or court-ordered termination of their parental rights (usually based on abandonment). The adoption is permanent and results in a new birth certificate listing the adoptive parent.
