What is adult adoption?

Adult adoption is a court process that creates a legal parent-child relationship with an adult adoptee. Families often use it to recognize the bond between a stepparent and someone they raised. Eligibility, consent, notice and the adoption's legal effects depend on the state.

Start with eligibility

Do not assume that reaching 18 settles every requirement. Check the state's adoption rules, the parties' residence, any age difference or relationship condition, and each person's marital status. The adult's agreement is central, but some proceedings also require a spouse's consent or participation.

Consent does not settle notice

Florida section 63.062(8) requires the adult's written consent, generally the adult's spouse's consent, and notice of the final hearing to parents or proof of service. New York section 115(10) permits the court to direct notice in adult adoption. In contrast, Rhode Island section 15-7-5 expressly removes parental consent and notice for an adoptee aged 18 or older. Follow the actual filing state's rule.

Assemble the right court packet

The paperwork commonly includes a petition, an adoption agreement or consent, required spouse documents and a proposed order. Court checklists differ. California Courts' adult-adoption guide explains that local court forms and instructions matter; it also explains the court's ability to require notice or investigation. Do not borrow the minor-child packet or assume all review is prohibited.

Understand the lasting effects

Discuss legal parentage, birth records, a possible name change, and inheritance before signing. Adult adoption can affect relationships with the birth family, with exceptions determined by state law. Existing wills, trusts, benefit rules and medical planning deserve separate review; the decree is not an automatic entitlement to every benefit.
