What if the biological parent lives in another state — can I still adopt in Virginia?

Yes. A biological parent who lives in another state does not stop you from pursuing a stepparent adoption in Virginia. What the Virginia statute looks to is that you are a natural person who resides in the Commonwealth (Va. Code § 63.2-1201). The out-of-state parent's role comes down to giving consent or being properly notified.

Where you file: Your petition goes to the Circuit Court. Virginia has no minimum residency period before you can file (Va. Code § 63.2-1201). The question is whether you live in Virginia, not how long you have lived here. If you are unsure which county or city court is the right one for your address, the Circuit Court clerk can tell you.

Consent from a parent in another state: Virginia's process involves a petition for adoption, consent forms or a motion to dispense with consent, and your spouse's consent to the adoption.

  • If the other parent is willing, consent forms are the usual route.
  • If the other parent will not consent, the paperwork includes a motion to dispense with consent. Whether the court grants it depends on the facts of your case, so talk to an attorney about that issue.
  • Virginia sets the abandonment period at 6 months (Va. Code § 63.2-1202(H)). Whether a parent's absence meets that standard is a fact-specific question for the court.
  • If your child is 14 or older, the child's own consent is also part of the process (Va. Code § 63.2-1202).

Notifying a parent who lives elsewhere: Virginia allows personal service. If you do not know where the parent is, it allows service by publication after a diligent search. The clerk can confirm the exact steps for serving someone in another state, including who may deliver the papers and how proof is filed.

If the parent is in the military: Virginia has special provisions for military parents. If the other parent is stationed away from home, ask the clerk or an attorney how those provisions apply to your situation.

Home study: Virginia waives the home study for stepparent adoptions (Va. Code § 63.2-1242). The other parent living out of state does not by itself add a home-study step, but ask the clerk whether your judge has any additional expectations.

Timeline and cost: Stepparent adoptions in Virginia typically take 3-6 months. Court filing fees run $150-$300, and the total typical cost is under $1,000 when you handle the filing yourself. Reaching an out-of-state parent for consent or service can add time, so build in some room.

When to get extra help: If the other parent is contesting, cannot be found, or you are unsure whether the abandonment period applies, a Virginia family law attorney can advise you on that specific issue.
