Yes. You can ask a South Dakota Circuit Court to grant a stepparent adoption even if the child's other biological parent lives in another state. How that parent is notified and how their consent or non-consent is handled depends on your situation.
What stays the same. A parent's location doesn't change the basic South Dakota framework:
- Court: Your adoption is handled by the Circuit Court in one of South Dakota's 66 counties. The clerk in your county can confirm exactly where your case should be filed.
- Residency: South Dakota has no minimum residency period.
- Child's consent: If the child is 12 or older, the child's consent is part of the process under SDCL § 25-6-5.
- Home study: South Dakota waives the home study for stepparent adoptions under SDCL § 25-6-10.
- Termination: South Dakota does not treat termination of parental rights as a separate case in a stepparent adoption.
- Timeline: Stepparent adoptions in South Dakota typically take 3-6 months.
If the out-of-state parent is cooperative. A parent who agrees to the adoption is usually the simplest situation. Practical questions, such as how and where they sign, whether notarization is needed, and how the signed paperwork gets to the court, are best confirmed with the Circuit Court clerk in your county before you start. Different counties can have different filing preferences.
If the parent is not cooperative or can't be found. This is where the facts matter most. South Dakota's abandonment period is 6 months under SDCL § 25-6-4(2), and that provision may be relevant if the other parent has been absent. Whether it applies to your family, and how a parent in another state must be formally notified, are questions for the Circuit Court clerk or a South Dakota family law attorney. The same is true if the parent objects, if you can't locate them, or if you're unsure of their legal status. A contested case is not something to handle from a general guide.
Questions to ask the clerk. Before filing, it helps to ask:
- How must a parent who lives outside South Dakota be notified?
- What form should an out-of-state consent take?
- What is the current filing fee in your county?
- Does the court expect a hearing, and can it be scheduled around your out-of-state parent's availability?
The governing law is in South Dakota Codified Laws Chapter 25-6, and your case is decided under South Dakota's rules in a South Dakota court.
