What if the biological parent lives in another state — can I still adopt in New Jersey?

Yes. A biological parent who lives in another state does not stop you from pursuing a stepparent adoption in New Jersey. The out-of-state parent mainly affects how that parent is located, notified and asked for consent, not whether you can start the process.

Where and how you file: Stepparent adoptions in New Jersey go through the Superior Court in your county. New Jersey has no minimum residency period for filing (N.J.S.A. § 9:3-42), so you do not have to wait out a set number of months before you begin.

If the other parent is cooperative: A parent who agrees to the adoption can usually be brought into the process without much difficulty, even from far away. The Superior Court clerk in your county can tell you what form the court wants an out-of-state parent's paperwork to take, such as how it is signed and witnessed.

If the other parent is hard to find: New Jersey allows service by publication when the other parent's location is unknown after diligent search efforts. That means a parent who has dropped out of contact, and whose address you cannot find despite real effort, does not automatically block the case. Keep a record of every attempt you make to find them, because the court will look at your search.

If the other parent objects or has been absent: New Jersey's abandonment period is 6 months (N.J.S.A. § 9:3-46). How that applies depends on the facts, such as contact, support and the history between the parent and child. A parent who contests the adoption, or a situation where the facts are disputed, is a good time to talk with a New Jersey family law attorney about your specific case.

What stays the same:

  • Home study: It is waived in New Jersey stepparent adoptions (N.J.S.A. § 9:3-48), so the other parent living out of state does not add one.
  • Timeline: Stepparent adoptions in New Jersey typically take 3-6 months. Finding or notifying a parent in another state can be one of the steps that takes time, so start that part early.
  • Court costs: The court filing fee typically runs $200-$350, and the total cost is typically under $1,000 when you file without an attorney. Attorney representation typically costs $3,000-$5,000+.

What to ask your county clerk: Because details can differ, it is worth confirming a few points with the Superior Court clerk where you will file:

  • How the court wants an out-of-state parent served or notified
  • What the court requires before it allows service by publication
  • Whether a consent signed in another state needs anything extra
