What are the most common mistakes families make with stepparent adoption in Washington?

The most common mistakes Washington families make with stepparent adoption are assuming the other parent's consent is always required, misunderstanding how abandonment works, overlooking the child's own consent at 14, skipping steps like background checks and the home study, and filing incomplete or incorrect paperwork with the Superior Court.

Assuming you must wait to qualify. Washington has no minimum residency period (RCW 26.33.030) and doesn't specify a minimum marriage duration. Waiting for a deadline that doesn't exist only delays the process, and a typical stepparent adoption takes 3-6 months.

Assuming the other parent's consent is the only path. Many families believe a parent who refuses to sign ends the process. Washington's abandonment provision (RCW § 26.33.120) has no fixed number of months. It depends on the parent's overall conduct. Sporadic child support doesn't by itself prevent an abandonment finding, because courts look at the whole relationship, not just money. Every case turns on its facts, so if the other parent contests the adoption or can't be located, talk with an attorney or the Superior Court clerk in your county about your situation.

Forgetting the child's consent. A child who is 14 or older has a consent requirement under RCW § 26.33.160. Talk with your teenager early so the decision doesn't come as a surprise.

Overlooking background checks and the home study.

  • Washington requires criminal background checks for adoptive parents, so plan for that step.
  • The home study is not automatically waived in stepparent adoptions (see RCW 26.33.220). Ask the clerk whether the court will waive it in your case.

Filing in the wrong place or with the wrong paperwork. Washington has 39 counties, and your adoption is filed with the Superior Court. Incomplete or mismatched forms can cause delays. Confirm your county's local filing details with the clerk.

Overestimating the cost. The court filing fee typically runs $200-$500, and the total cost of a stepparent adoption is typically under $1,000 when you handle the filing yourself. Attorney representation commonly runs $3,000-$5,000+. Some families put off adopting because they assume it will cost far more.

Not planning for records afterward. Once your adoption is final, the Washington State Department of Health Center for Health Statistics is the agency to ask about birth records. Keep copies of your decree handy.

Treating a complicated situation as a simple one. If the other parent is unknown, actively objecting, or the facts are unusual, the answer depends on details. An attorney or the Superior Court clerk can address that specific issue.
