The man on my child's birth certificate is not the biological father — how does this affect adoption in Alabama?

3 min readHelping families since 2001Alabama

In Alabama, a birth certificate that lists a man who is not the biological father can affect whose consent or notice your stepparent adoption needs, so confirm who counts as your child's legal father with the Probate Court clerk or an attorney before you file. The answer depends on your family's facts, and we can't tell you from here how the court will treat your situation.

What stays the same. Your case is filed in the Probate Court. Alabama has no minimum residency period for the stepparent adoption petition (Ala. Code § 26-10E-5(e)(3)). A legally married spouse can adopt their partner's child through the stepparent process.

Consent and the other parent. An Alabama stepparent adoption packet includes a Petition for Adoption, either consent forms or grounds for implied consent, and your spouse's consent to the adoption. The parent whose rights are in question has to either consent or be addressed through those grounds. Alabama's abandonment ground uses a 4-month period (Ala. Code § 26-10E-9(a)(1), (a)(4)). The data doesn't cover how that applies when the man on the birth certificate is not the biological father, or when another man could claim to be the father. Ask the Probate Court clerk in your county or an attorney about those questions.

If a parent can't be found. Alabama allows personal service, or service by publication if a person's location is unknown. If you aren't sure where the man on the birth certificate is, this is the part of the process that would apply.

Your child's consent. If your child is 14 or older, the child's own consent is part of the process (Ala. Code § 26-10E-7(a)(1)).

Home study. Alabama does not waive the home study in stepparent adoptions (Ala. Code § 26-10E-26(2)). Expect a DHR pre-placement investigation as part of your case.

Timeline and cost. Stepparent adoptions in Alabama typically take 3-6 months. Court filing fees run $200-$350, and the total cost is typically under $1,000, compared with $3,000-$5,000+ with an attorney.

The birth certificate itself. The Alabama Center for Health Statistics handles vital records. If you have questions about the certificate, they and the Probate Court clerk can tell you what applies to your child's record.

When to get legal advice. Talk to an attorney if the biological father is known and might object, if there is any pending or past court case about paternity, or if you can't tell who the legal father is. These situations turn on specific facts, and a lawyer can advise you on your own circumstances.
