Your husband can ask the Circuit Court for a stepparent adoption in South Dakota even when no father appears on the birth certificate. What the court will require about the biological father, though, depends on the facts of your situation.
Why the blank birth certificate doesn't settle it. A missing name tells the court something, but it doesn't answer whether the father is truly unknown, whether you know who he is, or whether he has ever been involved. South Dakota law on how each of those situations is handled, including whether he must be notified, should be confirmed with the Circuit Court clerk in your county or with an attorney. This matters most if the father is known and might object.
What South Dakota law does tell us:
- Court: Stepparent adoptions are filed in Circuit Court in the county where you file.
- Abandonment: South Dakota's abandonment ground, SDCL § 25-6-4(2), uses a period of 6 months. Whether it applies to a father who was never named is a question for the clerk or an attorney.
- Child's consent: If your child is 12 or older, the child's consent provision, SDCL § 25-6-5, comes into play.
- Residency: South Dakota has no minimum residency period for filing.
- Home study: It is waived under SDCL § 25-6-10, so you generally aren't looking at a separate home study step.
- Timeline: Stepparent adoptions here typically run about 3-6 months.
Questions to settle first. Before filing, it helps to be clear on these points:
- Do you know who the biological father is, or is his identity truly unknown?
- Has he ever had contact with your child or been involved in any way?
- Has anyone ever named him in a court case or other legal paper?
- Is there any chance he would object?
If the answers are simple and uncontested, the clerk can often explain what the court wants to see. If the father is known and could contest, or if his identity is unclear, a family law attorney can advise on that specific issue. We don't give legal advice on individual situations.
Records. If you need a copy of the birth certificate or have questions about what it shows, South Dakota Vital Records is the agency to contact. For the filing fee and any local forms or procedures, the clerk in your county can give you current figures.
