After the adoption order, the appropriate vital-records agency handles any new or amended birth record. Court finalization, reporting the adoption, and receiving a certified certificate are separate steps. Do not assume the certificate arrives automatically with your document-preparation package.

Start with the place of birth

Identify where the original birth was registered, even if the adoption court is in another state. Ask the court which report it sends and which agency will process the record. Keep the certified adoption order and the adoptee's identifying information available.

A concrete Florida example

The Florida Department of Health's adoption procedures say the clerk forwards an adoption report within 30 days of the order. For a Florida birth, the department uses the report to create the new record. If the child was born elsewhere, the report is forwarded to the state of birth, whose requirements must be checked.

Florida lists an amendment fee of $20, including one certification. That is Florida's published fee, not a nationwide promise. Processing time, applications and extra-copy charges must be confirmed with the agency that holds your record.

Check the proposed name carefully

If a name change was requested and granted, make sure the court order and adoption report match. Do not assume an adoption automatically changes the surname. Check the issued certificate and request correction instructions promptly if there is a discrepancy.

Original records have separate access rules

The old statement that every original birth certificate becomes accessible only through a new court order was too broad. Access to original records depends on the jurisdiction and requester. For example, Oregon's courts explain that adult adoptees can obtain original Oregon birth certificates through the Oregon Health Authority. Florida has its own original-record application process.
