Is there an age limit for adult adoption in Washington DC?

In Washington DC, the age that matters is 18: a person over eighteen may be adopted, and the adoption provisions state no upper age for the adoptee, no minimum age for the adopting person, and no required age gap. If you are wondering whether you or your adult child is "too old," the statute does not point to a cutoff. Because the court must be satisfied that the adoption should be granted, the Superior Court clerk or an attorney can tell you how that applies to your situation.

What the law says about age.

  • D.C. Code § 16-303 says a person, "whether a minor or an adult," may be adopted.
  • D.C. Code § 16-304 allows the adoption of a person over eighteen on the petition of the adopting parent or parents, with the adoptee's consent, if the court is satisfied that the adoption should be granted.
  • D.C. Code § 16-302 says any person may petition. No minimum age or age gap is stated there. If you have a specific age-related question, the clerk or an attorney can confirm how the court approaches it.

Consent. The adult adoptee must consent, and consents must be written and acknowledged before an authorized officer. The parental-consent rules in D.C. Code § 16-304 apply only to adoptees under 18, so they are not the focus of an adult adoption. If you are married, your spouse must join the petition. A spouse who is the adoptee's natural parent only needs to consent (D.C. Code § 16-302).

Residency. Under D.C. Code § 16-301(b), the court has jurisdiction if the petitioner is a legal resident of DC or has actually lived in DC for at least one year before filing. Whether the other residency grounds in that section apply to an adult adoption is a point to confirm with the clerk or an attorney.

Home study. The court dispenses with the investigation, report, and interlocutory decree when the adoptee is an adult (D.C. Code § 16-308). Ask the clerk whether any background-check step still applies in your case.

Court and timeline. Adult adoptions in DC are filed in the Superior Court of the District of Columbia. A typical adult adoption takes about 4-8 weeks. The clerk can confirm current filing fees and any local filing steps.
