Is there an age limit for adult adoption in Hawaii?

Hawaii's adult adoption law does not set an upper age limit or an age-gap condition. It says "Any person may be adopted under this chapter" (HRS § 578-1), as long as the adult adoptee gives written consent. There is also no relationship or disability condition for the adoptee.

What the law does say about age:

  • The person being adopted: They must be an adult who gives written consent. No maximum age appears in the Hawaii provisions.
  • The person adopting: HRS § 578-1 allows petitions from "any unmarried adult person, person married to the legal birthing parent or non-birthing parent of a minor child, or married couple jointly." It does not state a numeric age for the adopting adult, so ask the Family Court clerk in your county to confirm that number.
  • Age gap: No age-gap rule appears in the sections reviewed. If your situation involves a close age difference, the Family Court clerk or an attorney can tell you how the court views it.
  • Existing legal relationship: The person adopting must not already stand in a legal parent-child relationship with the adoptee.
  • The adult adoptee must consent in writing.
  • If the adoptee is married, the spouse's written consent is also needed.
  • The adoptee's parents' consent is not required (HRS § 578-2(c)(1)(J)).
  • Hawaii's child consent age of 10 applies to minors, so it does not come into play when the adoptee is an adult.

How the process works:

  • Court: Your petition goes to the Family Court of the circuit. Venue is where the petitioner(s) live or are in military service, or where the adoptee lives or was born.
  • Residency: There is no separate residency requirement.
  • Investigation: The court must notify the Director of Human Services and allow time for an investigation and report (HRS § 578-8(a)). The court may waive this by written order if the adoptee's best interests require it (HRS § 578-8(b)).
  • Hearing: A hearing is required. The petitioners, any legal parent married to a petitioner, and any adoptee whose consent is required must appear personally unless the court expressly excuses them.
  • Timeline: Adult adoptions in Hawaii run about 4-8 weeks.

When to ask for help: If a family member objects, or your situation is unusual in some other way, talk to the Family Court clerk or an attorney about that specific issue. This page is general information, not legal advice for your case.
